PERLINDUNGAN HAK HADHANAH PASCA PERCERAIAN DALAMPERSPEKTIF HUKUM ISLAM: ANALISIS PUTUSAN PENGADILANAGAMA SUKOHARJO Nomor 1053/Pdt.G/2014/PA.Skh

The revocation of hadhanah claims in divorce cases is legal issues that have implications not only on procedural aspects, but also for the protection of children's rights after divorce. This study aims to analyze the concept of hadhanah from the perspective of Islamic law and positive Indonesian law, examining the judge's legal considerations in the Sukoharjo Religious Court Decision Number 1053/Pdt.G/2014/PA. Skh, as well as analyzing the juridical implications of the revocation of hadhanah claims on the protection of children's rights. This research is a normative legal research with a statutory approach, a conceptual approach, and a case approach. The legal material used consists of primary, secondary, and tertiary legal material that is analyzed qualitatively through a descriptive-analysis method. The results of the study show that the concept of hadhanah in Islamic law is an obligation of parents that is oriented towards the benefit of the child (maṣlaḥah al-maḥḍūn) and the protection of offspring (ḥifẓ al-nasl), which is in line with the provisions of the Marriage Law, the Drafting of Islamic Law, and the Child Protection Law which prioritizes the principle of the best interests of the child. The judge's consideration in the Decision of the Sukoharjo Religious Court Number 1053/Pdt.G/2014/PA. Skh is procedurally in accordance with the principle of disposition in the civil procedure law because the revocation of the lawsuit is carried out before the defendant gives an answer. However, the revocation of hadhanah claims results in the absence of a determination regarding the right to custody and fulfillment of children's rights, which has the potential to create legal uncertainty and does not fully reflect substantive protection of the best interests of the child. This study concludes that the settlement of family cases requires harmonization between the principle of disposition in civil procedure law and the principle of child protection so that court decisions not only guarantee procedural law certainty, but also realize substantive justice for children as legal subjects who must obtain optimal protection
